These Terms of Use (the "Terms") govern your access to and use of the Resonance mobile and web application (collectively, the "Service"). The Service is owned and operated by Lavendaire, Inc., a California S-Corporation ("Lavendaire," "we," "our," or "us"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

These Terms of Use (the "Terms") govern your access to and use of the Resonance mobile and web application (collectively, the "Service"). The Service is owned and operated by Lavendaire, Inc., a California S-Corporation ("Lavendaire," "we," "our," or "us"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Social Login: If you log in through a third-party provider (Google, Apple, Facebook), you authorize us to receive limited information from that provider as permitted by their terms and privacy policies.

  • Upload viruses, malware, or harmful code

  • Interfere with or disrupt the Service's operation

  • Use the Service for any unlawful purpose

User Content: The Service allows you to share listening statistics, personality assessments, and gamification achievements ("User Content"). By sharing User Content, you grant Lavendaire a non-exclusive, worldwide, royalty-free license to display, reproduce, and use your User Content in connection with operating and promoting the Service. You represent that you own or have rights to submit your User Content. We may remove User Content that violates these Terms.

Limited License: We grant you a limited, non-exclusive, revocable license to access and use the Service for personal, non-commercial purposes. You may download our mobile app and stream or download audio content (where available) solely for personal use.

You May NOT:

Subscription Plans: To access premium features, purchase a monthly, annual, or two-year subscription (when available). Subscriptions automatically renew at the end of each billing period until canceled. By subscribing, you authorize our payment processors (Stripe, Apple App Store, Google Play, RevenueCat) to charge your payment method at the then-current rate plus applicable taxes.

Free Trials:

We may offer different types of free trials from time to time.

  • Beta Trial: Users who join during our beta launch may receive a 30-day free trial with full access to Resonance. No payment information is required. At the end of the trial, your account will automatically downgrade to the free tier unless you choose to subscribe.

  • Standard Trial: New subscribers may be eligible for a 14-day free trial, which may require providing payment details. Unless canceled before the trial ends, the subscription will automatically begin and renew according to your selected plan.

Trial availability and duration may vary by promotion and are subject to change at our discretion.

Cancellation: Cancel anytime through your account settings or the relevant app store. Cancellation takes effect at the end of your current billing period. You retain access through the end of the paid period, but no refunds or pro-rated credits are provided for unused time, except as stated below.

30-Day Money-Back Guarantee: If you are not satisfied within the first 30 days of your initial paid subscription, contact support@lavendaire.com for a full refund. After 30 days, all subscription fees are non-refundable except as required by law.

App Store Purchases: For subscriptions purchased through Apple App Store or Google Play, refund requests must be submitted directly through those platforms.

Failed Payments: If payment fails, we may suspend your access. You remain responsible for unpaid amounts. We may retry payment multiple times.

Pricing Changes: We may change subscription fees with notice. Changes apply to your next billing cycle.

Your Rights: You have a limited, non-exclusive license to access and stream content for personal, non-commercial use only. You may not reproduce, distribute, publicly perform, or create derivative works without express written permission from Lavendaire and the applicable rights holders.

DMCA Copyright Policy: If you believe any content infringes your copyright, contact support@lavendaire.com with: (a) description of the copyrighted work, (b) location of infringing material, (c) your contact information, (d) statement of good faith belief that use is unauthorized, (e) statement under penalty of perjury that the notice is accurate, and (f) your signature. We will respond to valid DMCA notices and may terminate accounts of repeat infringers.

Binding Arbitration: If mediation fails, the dispute will be resolved by final and binding arbitration, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration may occur in California or via remote means. The arbitrator’s decision will be final and enforceable in any court of competent jurisdiction.

  • You and Lavendaire agree to bring claims only in your individual capacities, not as part of any class, consolidated, or representative action.

  • You waive the right to a trial by jury.

Exceptions: Either party may seek relief in small claims court or pursue injunctive relief for intellectual property concerns.

  • Apple and its subsidiaries are third-party beneficiaries and may enforce these Terms

You must comply with Apple's App Store Terms of Service.

Google Play Store: If you downloaded the Service from Google Play:

  • These Terms are between you and Lavendaire, Inc., not Google LLC

  • Google has no obligation to provide maintenance or support

  • Google is not responsible for the Service or its content

  • Google has no warranty obligation

You must comply with Google's Play Store Terms of Service.

App Store Refunds: For subscriptions purchased through app stores, refund requests must be submitted directly through Apple or Google.

Electronic Communications: By using the Service, you consent to receive electronic communications from us (service announcements, account notifications, subscription reminders, marketing emails). You may opt out of marketing emails. Electronic communications satisfy any legal requirement for written communications.

Export Controls: You agree to comply with all applicable U.S. export and re-export control laws.
